Every Paddle Tells a Story — Competition Privacy Notice

1. Who we are

This notice explains how personal information is used for the Every Paddle Tells a Story — What’s Yours? competition (the “Competition”).

The data controller is Marcello Sports, of 15B Beveridge Lane, Ellistown, Coalville, LE67 1FB, United Kingdom (“Marcello”, “we”, “us” or “our”).

2. Information we collect

We may collect and use:

  • your full name and email address;
  • the platform you entered on and your public social-media username or profile information;
  • the content type you selected and the public link to your post;
  • the photo, video, caption, comments and other information made public as part of the submitted post;
  • your eligibility, content-permission and optional marketing confirmations;
  • messages and correspondence about your entry;
  • reasonable evidence requested to verify age, UK residence, permissions, ownership or legitimate use of a genuine Marcello paddleboard;
  • judging scores, eligibility decisions and records of the Competition process; and
  • if you receive a prize or reward, your delivery address, reward choice and fulfilment information.

Please do not send identity documents or other sensitive information unless we specifically request it and explain why it is needed. Where possible, you should cover information that is not necessary for verification.

3. Information about other people

Your submitted content may show other people. You must have permission from every identifiable adult shown. If an identifiable person under 18 appears, you must have permission from that child’s parent or legal guardian.

We do not ask entrants to provide children’s names or contact details. Please do not include unnecessary personal information about a child in a caption, entry form or message to us.

4. How we use personal information and our legal bases

Prevent duplicate or fraudulent entries, keep an audit trail, resolve complaints and demonstrate that the Competition was run fairly. Our legitimate interests in protecting the Competition, our business and entrants, and in complying with applicable promotional rules.
Use submitted content under the content licence set out in the Competition Terms. Performance of the Competition agreement with you and our legitimate interests in administering and publicising the Competition.
Send Marcello news and offers by email. Your consent. Marketing permission is optional and can be withdrawn at any time.
Meet legal, regulatory, tax, accounting or law-enforcement requirements. Compliance with a legal obligation and, where relevant, our legitimate interests in establishing or defending legal claims.

5. Public social-media information

To assess an entry, we review the public post and relevant public profile information on Instagram or TikTok. The social-media platform processes information under its own privacy policy. We do not control the platform’s independent use of that information.

6. Who we share information with

We may share personal information only where necessary with:

  • Shopify and service providers that host our website, entry form, email or business systems;
  • the judging panel, including the independent judge, using only the information reasonably needed for judging;
  • couriers, fulfilment providers and product suppliers involved in delivering prizes or rewards;
  • professional advisers, insurers, auditors or technical support providers;
  • regulators, courts, law-enforcement bodies or other authorities where required by law; and
  • the Advertising Standards Authority where evidence about the Competition or a valid award is requested.

We do not sell entrants’ contact details.

7. International transfers

Some service providers, including Shopify and social-media platforms, may process information outside the United Kingdom. Where UK data-protection law requires it, we use providers that rely on an adequacy regulation or appropriate safeguards, such as approved contractual protections. You may contact us for more information about the safeguards relevant to your information.

8. How long we keep information

  • Entry and eligibility-administration records for entrants who do not receive a ranked prize are normally kept until 12 months after all prizes and rewards have been fulfilled.
  • Winner, prize, judging, complaint and core Competition audit records may be kept for up to six years after the Competition ends where reasonably necessary to demonstrate compliance, handle claims or meet accounting and legal requirements.
  • Delivery details are kept only as long as reasonably necessary to fulfil the prize or reward and deal with delivery queries, unless a longer period is legally required.
  • Marketing-consent records are kept while you receive marketing and for a reasonable period afterwards to demonstrate your consent or record an unsubscribe request.
  • Copies of submitted content used under the Competition licence may be kept for the licence period stated in the Competition Terms, together with a limited record of the permission granted.

We may keep limited information for longer where required by law or where necessary to establish, exercise or defend legal claims.

9. Marketing choices

Choosing to receive Marcello news and offers is optional and does not affect entry, eligibility, judging, prizes or rewards. You may withdraw consent at any time by using the unsubscribe link in a marketing email or by contacting us at marcellosupplier@gmail.com.

10. Your rights

Depending on the circumstances, you may have the right to:

  • ask for access to your personal information;
  • ask us to correct inaccurate or incomplete information;
  • ask us to delete information;
  • ask us to restrict how information is used;
  • object to processing based on legitimate interests;
  • receive certain information in a portable format; and
  • withdraw consent at any time where processing relies on consent.

You have an absolute right to object to the use of your personal information for direct marketing.

These rights are not absolute in every situation. We may need to retain limited information where required by law or where necessary to administer an existing claim fairly. We may ask for information needed to confirm your identity before responding.

11. Automated decisions

We do not use solely automated decision-making to select winners. Eligibility checks and judging decisions involve people.

13. Changes to this notice

We may update this notice if our use of personal information or the law changes. Any material update affecting Competition entrants will be communicated reasonably and the updated date will be shown at the top of this page.
